How to register your house with the Public Registry of Property and Commerce

The Public Registry of Property and Commerce is an institution in charge of keeping a note of all the legal processes involved in a property. From its acquisition or its legal situation (mortgages, liens, credits), until its sale.

Requirements to register a property with the Public Registry of Property and Commerce
• Public title deed
This document is obtained when purchasing your home and although the certification is made before a notary public, it is in the registration of the Registry where it obtains its legal validity. If you do not have the deed of your property, you must go to the notary where the document was issued to request a certified copy.
• Purchase contract
In the event that the house has been previously registered by the ex-owner, it is necessary to register the action taken, in order to transfer the title and rights of the property to the new owner.
Either of the two documents you present must be accompanied by a certified copy, authorized and signed by the notary (ratified) and bear the seal of the notary's office.
• Request for the procedure
You can download the application directly from your local Public Registry page. In it you must mark the type of registration that will be carried out, provide your personal data, those of the property, the registration background and the data provided by the notary.
Documents presented at the event to be registered
The documentation obtained will depend on the act that is carried out, but basically they are:
• Commercial appraisal of the property
• Certificate of Freedom from Encumbrance, issued before the Public Property Registry and of fiscal order
• Income Tax Declaration
• Declaration of Property Acquisition Tax
• Receipt of the property tax current payment.

Those involved must present an official photo ID as well as corresponding copies to register.

The cost of the process is established according to the process that will be requested. For example, in case of home registration, the cost varies according to the value of the home. Only in Mexico City, popular interest homes that exceed $ 870,000 pesos, will have to pay around $ 17,500 pesos for registration fees. For any other service, the costs range from $ 294 pesos to $ 1,100 pesos.
