I'd give Nintendo a call; if you have any information on the console like and internal serial number or something that will help verifying the machine, which would likely be the easiest way for Nintendo to track it.

The games are tied to the console, but if you call Ninty they might work with you and allow you to re-download them on a new console using your same account. They can.
